Defending 2nd Amendment Rights

We live in a time when international organizations and our own federal government are devoting significant efforts to eliminate the right of Americans to keep and bear arms. We must forcefully echo the Declaration of Independence and insist that the first duty of government is to provide for our safety. At the core of this is the Constitutional right of the people to provide for their own safety.
 

THE GINGRICH RECORD DEFENDING SECOND AMENDMENT RIGHTS:

Newt has been a committed and vigilant defender of Second Amendment rights since first being elected by the people of Georgia’s Sixth District in 1978.

Newt is a lifetime member of the National Rifle Association, and speaks regularly at the NRA’s Annual Meeting. He received an A or A-plus rating from the NRA all ten terms that he served in the House of Representatives, and received the NRA’s Defender of the Second Amendment award in 2010.

WHAT NEWT WILL DO ON DAY ONE:

Instruct the Department of Justice and State Department to defend American sovereignty and block all international treaties that infringe on Second Amendment rights.

Take immediate steps to decisively control the border so Mexican drug cartels are blocked from entering the United States.

End all illegal gun exports to Mexico by the federal government.

End the discriminatory treatment of firearms imports. If a gun can be legally made and sold in the United States, it should be importable from outside the United States.

Gun Owners Scores a Victory for
Individual Privacy in the Supreme Court

The Supreme Court yesterday unanimously sided with Gun Owners of America in finding that the placement of a Global Positioning Device on an automobile constitutes a “search” for purposes of the Fourth Amendment.

The majority opinion in U.S. v. Jones was written by Justice Antonin Scalia and follows GOA’s reasoning to throw out the “reasonable expectation of privacy” test which has been thought to be the dominant Fourth Amendment standard in recent years.

The Obama Administration argued that because the police could theoretically follow Antoine Jones’ car, he had no “reasonable expectation of privacy,” and thus, placing a GPS device on his car was justified. GOA argued, however, that this constituted an “unreasonable search and seizure” which violates the Fourth Amendment of the Constitution.

This decision will have dramatic ramifications for gun owners. Indeed, the Court looked to the Founders’ intentions with respect to the Fourth Amendment, which, until the latter part of the 20th Century, was understood to restrict the ability of police to “trespass” upon the persons or property of Americans.

“This is no less than a fundamental transformation of American jurisprudence concerning searches and seizures,” according to GOA’s Executive Director Larry Pratt. “And it is a transformation which throws out fake modern jurisprudence and restores the Founders’ intent.”

The “reasonable expectation of privacy” test flowed from a Justice Harlan concurring opinion in Katz v. United States, 389 U.S. 347 (1967). Gun Owners of America had argued that the Supreme Court should jettison that decision by an activist court, and a majority of the justices agreed.

“The ‘expectation of privacy’ test for searches and seizures arose without support in the text or historical context of the Fourth Amendment, and has proven wholly inadequate to protect the American people from their government,” argued GOA.

Four members of the court -- led by Samuel Alito, and joined by Ruth Bader Ginsburg, Stephen Breyer, and Elena Kagan -- argued for the continuation of the “reasonable expectation of privacy test,” but concluded that planting a GPS device on a car for 28 days constituted a Fourth Amendment “search” under that standard as well.

The Obama administration, which had argued that planting a GPS device on a car was not a “search” under the Harlan standard, was unanimously repudiated by the High Court. And the case is being cited by the mainstream media as a defeat for Obama and his Justice Department, which is led by Attorney General Eric Holder.

Said Pratt: “This is yet another failure by Eric Holder, the most corrupt and incompetent Attorney General in the history of the Republic.”

I'm sorry Newt, that dog don't hunt. Just blocking drug cartels is not my main worry. I worry about th e20 million illegals you want us to absorb when we can't pay for our own. Open borders made the bubble worse because it allowed contractors to keep up with demand. If that had not been done, fewer homes would have been sold ($1.2 Trillion to illegals). No we don't have to round up 20 million, just round up the employers and punish them for aiding and abetting illegals being here. Nationalization Act Title 8.. just a reminder to the smartest guy in the room. You make the environment worse here for illegals than it is in Mexico, we won't have to worry about the impracticality of rounding up 20 million.

What would you do specifically to control the borders for anyone that wants to get in illegally and how fast would you let employers no that if they don't use e verify and act accordingly they are facing finds of $10,000 per illegal hired and possible jail time. You might want to tell the good Catholic Father of yours that this goes for churches too as stipulated in Nationalization Act Title 8.  I don't trust Newt on this, it's still too lawyereeze by limiting his security to drug cartels. Civilian invasions can be more devastating than war... I don't think Newt "gets it". yet. .. I'll work like hell for him in NC though if his group contacts me.. God Bless Gary

An organization called "National Association of Gun Rights" led by Dudley Brown, Exe. Director,  has bombarded the emails of Conservative voters with the message that Newt Gingrich has refused to answer questions from National Ass. of Gun Rights, concerning 2nd Amendment rights, therefore, Newt Gringrich is for gun control. Will you please answer the questionaire and put an end to the doubt in voters minds concerning Newt's stand on gun control. Romney, Huntsman Stonewall Gun Owners

As New Hampshire voters get set to head to the polls, Mitt and Jon Huntsman continue to ignore requests from gun owners that he return the GOA candidate questionnaire.

Thank to your efforts, we’ve heard from most of the Republican candidates, including Rick Santorum, Newt Gingrich and Ron Paul. But Romney and Huntsman continue to turn a deaf ear to the Second Amendment community.

Romney’s stonewalling is no surprise. After all, he is on record supporting a semi-auto ban and waiting periods for gun purchases. Still, he has the audacity to travel around the country claiming to be a supporter of the Second Amendment.

If he truly has “changed his spots,” then why not commit in writing to support specific Second Amendment issues?

For instance, would he veto a semi-auto ban, something he signed into law as Governor of Massachusetts? Will he reverse the Obama administration’s support of the massive UN small arms treaty? And what about executive orders, gun owner registration, and a host of other issues important to gun owners?

Jon Huntsman views on gun rights are largely unknown, but as the former Utah governor creeps up in the polls in New Hampshire, gun owners are becoming increasingly interested in his positions.

Huntsman said over the summer that he would “absolutely veto” a semi-auto ban, but he has not elaborated further.

There are some 100 million gun owners in America. It is outrageous for ANY candidate for elected office to ignore this vast segment of the population.

ACTION: Please contact the Romney and Huntsman campaigns and urge them to complete the GOA candidate questionnaire.

How to Stop Home Invasions? 12 Gauge Shotgun!

Sarah McKinley of Oklahoma City has had a holiday experience that no one should ever have to endure.

In September, Sarah, 18 years old, gave birth to a little boy. What should have been a blessed event and bring hope to the future, soon faded away as her husband died of cancer on Christmas Day. One of the two bright lights in Sarah’s life had been snuffed out and all she had left was her three month old infant son, to whom she clung to for all the world was worth.

On the day of her husband’s funeral, Sarah was visited by a young man who claimed to be a neighbor that just wanted to stop by and say hello. She did not let him in her house as she did not know him.

On New Year’s Eve, the same young man, 24 year old Justin Martin returned to Sarah’s house and wanted in. This time, Justin was accompanied by a friend, Dustin Stewart and a 12 inch long hunting knife. Fortunately Sarah’s doors were locked as the two men tried to enter the house, but could not.

Instead of leaving, they continued to knock on the door, try the door knob and then proceeded to check other doors and windows. Sarah quickly went to the bedroom, put a baby bottle in her son’s mouth, grabbed her 12 gauge shotgun and handgun and then called 911.

When speaking to 911, she asked if she was allowed to shoot an intruder since it was just her and her baby home alone. The operator said they could not give that permission but that she did need to use whatever means necessary to protect her son and herself.

Sarah shouted out to the would be intruders that she had a shotgun, but that did not deter them. Eventually, Martin kicked in Sarah’s door and went after her with the hunting knife in his hand. In an act of self-preservation, Sarah fired her 12 gauge shotgun, dropping Martin in his tracks. Martin’s accomplice, Dustin Stewart fled the scene, but later turned himself in to police.

When the police finally arrived they found Martin lying dead in a pool of blood. After examining the evidence of the door kicked in, the knife, and the 911 call, the police have ruled the shooting was a justified use of deadly force in self-protection.

If gun control advocates like Obama and Hillary Clinton had their way, it would have been illegal for Sarah to have had any firearms in the house, in which case the police would probably have found her body lying in pool of blood and her three month old son would have been dead or parentless for the rest of his life.

I once worked with a man who stood six foot four and was built like a football player. One day we got into a discussion about guns and he said he was against gun ownership and doing any harm to anyone else. I knew he had two young daughters and pretty wife, so I asked him what he would do if a guy broke into his house and started to physically and sexually attack his wife and daughters. He said he would try to get the guy to stop, but could never bring himself to use physical violence against the intruder, even it meant that his wife and daughters continued to be attacked and ravaged. He was a Roman Catholic and not a Quaker as some might think. When his wife found out about his pacifist views from another person involved in the conversation, she was furious that he would not rise to defend her or the girls.

This is the type of people that Obama and Clinton want all Americans to be like. They want them to be unarmed pacifists that won’t raise a finger against anyone else.

Not me! I believe that every man, woman and child in America needs to be like Sarah McKinley who not only has a loaded gun in the house, but knows how and when to use it. If more American’s were like her, I truly believe we would have a lot fewer home invasions, rapes and burglaries.

Thanks for gun ownership support I know these times the 2nd AMENDMENT RIGHTS are always under attack for me myself have lost rights due to the "brady act" and I would hope that if your elected you can work on turning this blatint law around and help protect this GOD GIVIN RIGHT!

Any politician that claims they support American's right to 'hunt' is an opponent of the Second Amendment. It has nothing to do with hunting, that is a 'spin-off, it has to do with our God given RIGHT to self defense from criminals and against 'progressive' politicians and external enemy's, (the U.N.).
